Terms of Service

1. Acceptance of Terms
By accessing or using the OMW Logistics System platform ("Service"), operated by OMW (On My Way) ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms apply to all users of the Service, including enterprise clients, dispatch operators, and authorized personnel accessing the platform on behalf of a business entity.
2. Description of Service
OMW provides an AI-powered omnichannel delivery orchestration platform that enables businesses to ingest orders from multiple communication channels (including WhatsApp, Telegram, Email, and REST APIs), process them through automated parsing and validation pipelines, and manage real-time dispatch operations through a centralized hub.
The Service is offered on a subscription basis to enterprise logistics operators. Access is restricted to authorized accounts provisioned by OMW.
3. User Obligations
You agree to:
- Maintain the confidentiality of your account credentials and restrict access to authorized personnel only.
- Use the Service solely for lawful business purposes related to logistics and delivery operations.
- Not attempt to reverse engineer, decompile, or extract proprietary algorithms from the Service.
- Not use the Service to transmit unlawful, fraudulent, or harmful content through any integrated channel.
- Notify OMW promptly of any unauthorized use of your account or any security breach.
4. Intellectual Property
All software, algorithms, interfaces, and content comprising the Service are the exclusive property of OMW and are protected by applicable intellectual property laws. Nothing in these Terms grants you ownership of or license to any intellectual property beyond the limited right to use the Service as described herein.
You retain ownership of all operational data (orders, routing records, courier assignments) generated through your use of the Service. You grant OMW a limited license to process this data solely to provide and improve the Service.
5. Service Availability
OMW targets 99.9% monthly uptime for all core platform components. Scheduled maintenance windows will be communicated at least 48 hours in advance. OMW is not liable for downtime caused by third-party communication providers (WhatsApp, Telegram, email infrastructure) or force majeure events.
6. Limitation of Liability
To the maximum extent permitted by applicable law, OMW shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of revenue, delivery failures, or data loss, even if OMW has been advised of the possibility of such damages.
OMW's total aggregate liability for any claims under these Terms shall not exceed the fees paid by you to OMW in the three months preceding the event giving rise to the claim.
7. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.
8. Modifications
OMW reserves the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email to the address associated with your account. Continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes.
